These Terms & Conditions ("Terms") govern your access to and use of the Truth or Dare Bot (the "Bot"), a Discord application operated by Vulps ("we", "us", "our"). By inviting the Bot to a Discord server or interacting with it as a user, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Bot and must remove it from any server you administer.
These Terms form a legally binding agreement between you and us. We reserve the right to update these Terms at any time. The effective date above reflects the most recent revision. Continued use of the Bot following any update constitutes acceptance of the revised Terms.
You must meet all of the following conditions to use the Bot:

The Bot provides an interactive Truth or Dare game experience within Discord servers. Core features include:
The Bot operates on the Discord platform and its availability is subject to Discord's own uptime and API limitations. We do not guarantee continuous, uninterrupted access to the Bot and accept no liability for downtime caused by Discord or third-party infrastructure providers.
If you invite the Bot to a Discord server that you administer, you accept the following responsibilities:

We reserve the right to determine, at our sole discretion, whether conduct constitutes a breach of these Terms.
You may submit custom truth or dare questions using the /create command. All submissions enter a moderation queue and are reviewed before being added to the question pool. We reserve the right to approve, reject, or remove any submission at our sole discretion without providing reasons.
By submitting a question, you grant Vulps a perpetual, royalty-free, worldwide, non-exclusive licence to use, display, distribute, and modify that content within the Bot and its associated services. You retain ownership of your original content.
By submitting content, you represent and warrant that:
We may remove any user-submitted content at any time without notice if we determine it breaches these Terms, applicable law, or Discord's policies. Where content is removed as part of a moderation action, the submitting user's account may also be subject to further action including a ban.
We operate a moderation system to maintain the safety and integrity of the Bot. Our moderators may:
Bans may be issued for breaches of these Terms, Discord's policies, or conduct our moderators determine to be harmful to the community. Ban decisions are at our sole discretion. You may contact us via our support server to raise a concern about a moderation decision. All moderation records, including ban reasons and timestamps, are retained as described in our Privacy Policy. Bans are logged against your Discord User ID and may apply across all servers using the Bot.
You may vote for the Bot on Top.gg. Votes are tracked within the Bot and may contribute to in-Bot rewards or acknowledgments. Votes are processed via Top.gg's webhook service; by voting, you are also subject to Top.gg's Terms of Service and Privacy Policy. Attempting to manipulate or automate votes is a breach of these Terms and may result in a ban.
Certain enhanced features of the Bot are available to servers with an active premium entitlement ("Premium"). Premium is purchased and managed entirely through Discord's built-in entitlement system, accessible via the Discord application store. All transactions, billing, and refund requests are handled directly by Discord in accordance with Discord's own Terms of Service and monetisation policies.
We have no visibility into or control over payment details, and we do not process payments directly. Any refund requests must be submitted to Discord. We have no ability to issue refunds independently.

Premium features are provided on a best-efforts basis. We do not guarantee uninterrupted access to Premium features and accept no liability for temporary unavailability.
The Bot delivers NSFW content and is intended solely for users aged 18 and over. By using the Bot, you confirm that you meet this requirement. Use of the Bot by anyone under the age of 18 is strictly prohibited. If you are a server administrator and become aware that a minor is accessing the Bot within your server, you must take immediate steps to restrict their access.
The Bot operates within the Discord platform and relies on Discord's NSFW channel designation system as a first layer of child safety protection. NSFW content delivered by the Bot is restricted to channels that a server administrator has specifically designated as NSFW within Discord's own settings. Discord, as a regulated service under the Online Safety Act 2023, applies its own controls to such channels.
As a third-party application operating within Discord's infrastructure, we do not control Discord's age verification mechanisms and cannot independently verify users' ages. We rely on server administrators and Discord's platform to ensure NSFW-designated channels are appropriately restricted.
We apply the following child safety measures independently of Discord's controls:
If you believe a child is being harmed or exposed to inappropriate content through the Bot, contact us immediately via our Discord support server at discord.vulps.co.uk or directly at Vulps22 on Discord. You may also report concerns to the Internet Watch Foundation or the NCA's CEOP Command. We will act on all credible child safety reports without delay.
All intellectual property rights in the Bot, including its code, design, branding, and non-user-generated content, are owned by or licenced to Vulps. Nothing in these Terms transfers any such rights to you. You may not copy, reproduce, distribute, or create derivative works from the Bot or its content without our prior written consent.
The Bot is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Bot will be error-free, uninterrupted, or free from harmful components. Your use of the Bot is entirely at your own risk.
To the fullest extent permitted by Scots law, we exclude all liability for:
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under Scots law.
We have no control over and accept no liability for the actions of Discord, Top.gg, or any other third-party platform or service. Any disputes with third parties are governed by their own terms and policies.
We may suspend or permanently terminate your access to the Bot at any time, with or without notice, for any reason including a breach of these Terms. You may stop using the Bot at any time and, if you are a server administrator, may remove it from your server.
Upon termination, any licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including Sections 6.2, 11, 12, and 15) will continue to apply.

These Terms are governed by and construed in accordance with the law of Scotland. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
If you are a consumer based in another part of the United Kingdom, you may have additional rights under the laws of your home jurisdiction, including the Consumer Rights Act 2015, which these Terms do not seek to limit.
